Shim Hyung Rae is Sentenced but Plans to Lodge an Appeal

Following a year-long court case filed against him for allegedly violating the Labor Standards Act, Shim Hyung Rae has been sentenced to 10 months in prison with a two year probation and 80 hours of social service.

Shim Hyung Rae has revealed he plans to lodge an appeal.

The comedian-turned-director was sentenced at the final trial held on January 16.

He was first sued in October 2011 for failing to pay his 43 employees the 891,530,000 won in salary and pension he owed them in total. He seemed determined to get to the bottom of the issue, turning in a written agreement on December 28, 2012 followed by a petition.

The justice department stated, "The accused used all methods available to him to solve the case, including paying part of the salaries due by auctioning off the Younggu Art Center. 19 of the 43 who didn′t receive their salaries, however, still want the accused punished, and the unpaid salaries still amount up to 260 million won, leading us to reach this decision."

It added, "We do believe the accused will have suffered from the case, which has lasted for over a year, but the employees who live on the salaries also suffered when they were not paid for six or seven months. We did take into consideration the accused′s circumstances and the possibility of his carrying out the social service sentence, but we did not consider any special circumstances in the decision."

Following the trial, Shim Hyung Rae stood before press and said, "I′m sorry for causing such trouble. I worked hard to export our films... but it was difficult."

He added, "I′ll make a return as soon as possible to pay back the unpaid salaries and lift the burden from my employees. It′s all my fault, and I regret it very much. Still, I′ve decided that I should use contract workers rather than permanent workers for my films in the future."

"I′m sorry. I will appeal the decision," he finished.

Shim Hyung Rae is currently aiming to make a return with a comedy piece set in Western America.
